Article 2 – Applicability

These general terms and conditions apply to every offer from LAHYATI CommV and to every agreement concluded between LAHYATI CommV and the customer.

By placing an order, the customer accepts these general terms and conditions.

Deviations from these terms are only valid if agreed upon in advance and in writing.

Article 3 – Offer and products

The products offered are cosmetic products, specifically products for beard and skin care.

The information, images and descriptions on the website are displayed as accurately as possible. Obvious errors or obvious mistakes do not bind LAHYATI CommV.

All products are intended for external use only.

Article 4 – Prices

All prices are expressed in euros and include VAT, unless expressly stated otherwise.

Any shipping costs will be clearly communicated before completing the order.

LAHYATI CommV reserves the right to change its prices.

Article 5 – Conclusion of the agreement

The agreement is concluded at the moment the customer places an order and receives confirmation thereof from LAHYATI CommV.

LAHYATI CommV reserves the right to refuse an order or request additional information if there are valid reasons for doing so.

Article 6 – Payment

Payment is made via the payment methods offered on the website.

The order will only be processed after full payment has been received.

Article 7 – Delivery

LAHYATI CommV will exercise the greatest possible care when processing and shipping orders.

Stated delivery times are indicative and not binding.

Delay in delivery does not entitle the customer to compensation or dissolution of the agreement, except in cases provided for by mandatory law.

Article 8 – Right of withdrawal (consumers)

The consumer has a right of withdrawal of fourteen (14) calendar days from the day of receipt of the product.

In accordance with the Economic Law Code, the right of withdrawal is excluded for:

cosmetic products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery.

Only unopened and unused products with an intact seal can be returned within the legal withdrawal period.

The costs of return are borne by the customer.

Article 9 – Use of the products

The customer undertakes to use the products exclusively in accordance with the instructions for use and for their normal purpose.

The customer is responsible for checking the ingredient list for allergies or sensitivities.

LAHYATI CommV is not liable for damage arising from:

Article 10 – Liability

LAHYATI CommV is only liable for damage that is the direct result of gross negligence or intent on the part of LAHYATI CommV.

In all cases, liability is limited to the amount of the order to which the damage relates, unless otherwise provided by mandatory legal provisions.

LAHYATI CommV is not liable for indirect damage, consequential damage, loss of profit or immaterial damage.

This provision does not affect the mandatory provisions regarding product liability.

All intellectual property rights relating to the website, products, texts, images, logos, designs and trade names belong to LAHYATI CommV.

It is prohibited to use, copy or disclose these without prior written permission.

Article 15 – Applicable law and competent court

All agreements between LAHYATI CommV and the customer are exclusively governed by Belgian law.

In case of dispute, only the competent courts of the judicial district of the registered office of LAHYATI CommV have jurisdiction, subject to mandatory legal provisions.
